Are all Financial Powers of Attorney the same?

No, there are several kinds of financial powers of attorney. They can take effect immediately (an immediate POA) or only upon the grantor being declared disabled by their doctor (a springing POA). Also a POA can be as broad or as narrow as the grantor desires.

Can a mentally incapacitated person give a power of attorney?

No. That is why it is vitally important to have a powers of attorney done sooner rather than later. Who knows what the future may hold?
